Identify every responsible party
A workers comp matter may involve the worker, employer, compensation carrier, medical providers, and possible outside tortfeasors. Record legal names, roles, addresses, insurers, and who controlled the activity or property.
Preserve the distinctive proof
Prioritize injury notice, job duties, payroll, restrictions, benefit records, and site evidence. Keep originals and record who created, obtained, transferred, or changed each item.
First question to resolve
Is the matter limited to employee benefits or is a separate third party involved?
Issues that may overlap
Check benefit eligibility, retaliation, subrogation, and third-party claims. Then identify the state, court, notice rule, and limitation question before assuming the ordinary injury process applies.
